CDI Warranty

MECHANICAL AND ELECTRONIC TORQUE PRODUCTS FULL 12-MONTH WARRANTY

CDI TORQUE PRODUCTS WARRANTS TO THE ORIGINAL PURCHASER OF TORQUE PRODUCTS THAT THE COMPANY’S TORQUE PRODUCTS ARE FREE FROM DEFECTS IN WORKMANSHIP AND MATERIALS. CDI TORQUE PRODUCTS will repair or replace torque products which fail to give satisfactory service due to defective workmanship or materials (excluding calibration) for 12 months from the date of original purchase. CDI TORQUE PRODUCTS warrants “initial, out of box calibration” of each new, unused torque product. Repair, replacement or recalibration shall be at the election and expense of CDI TORQUE PRODUCTS, and is your exclusive remedy in place of all other rights and remedies. Products must be returned with proof of purchase, freight prepaid, to a CDI TORQUE PRODUCTS repair center for warranty service.

CDI TORQUE PRODUCTS does not provide any warranty for products subjected to abnormal use. Abnormal use includes misuse, accident, modification, unreasonable use, neglect, lack of maintenance, or use after the tool is significantly worn.

“NO OTHER WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, SHALL APPLY, AND ALL SUCH WARRANTIES ARE HEREBY EXPRESSLY EXCLUDED.”

In no event shall Seller be liable to Buyer or anyone claiming through or against Buyer for any special, indirect or consequential damages (including, without limitation, lost profits, revenues, anticipated sales, business opportunities or goodwill; interruption of business; or loss of business information).

Mark-10 Warranty

Mark-10 Corporation expressly warrants to its buyer for three (3) years from the date of delivery that the goods sold are free from defects in workmanship and materials.

Mark-10 Corporation will, at its option, repair or replace or refund the purchased price of goods found to be defective. This remedy shall be the buyer’s sole and exclusive remedy. Any modification, abuse, exposure to a corrosive environment, or use other than intended will void this warranty.

This warranty is in lieu of all other warranties, including implied warranties of merchantability and fitness for an intended purpose. In no event implied shall Mark-10 Corporation be liable for any incidental and consequential damages in connection with goods sold or any part thereof.

Mitutoyo Warranty

Mitutoyo America Corporation (“Mitutoyo”) warrants all of its products sold and shipped in the United States and Canada for one year from the date of installation at the original purchaser facility. The description as shown below is not a warranty by itself and is for general information only. For warranty terms and conditions as they pertain to a specific product, contact your distributor or the manufacturer.

Mitutoyo warrants the products and software it manufactures and sells directly or through an authorized distributor if the product or software is in the possession of the original purchaser. Except for software, Mitutoyo will, at its option, repair or replace any part or parts, which upon examination, are found to be defective in workmanship or material, provided the product is returned to Mitutoyo and the purchaser can prove that the product has been used and maintained and, where applicable, installed in accordance with Mitutoyo instructions and has not been subject to abuse. For software, Mitutoyo will replace defective media or make a warranted program operate or replace the program with a functionally equivalent program as warranted, provided there is satisfactory documentation that the software has been installed, used, and maintained in accordance with Mitutoyo instructions in the User Manual and provided further that the customer can satisfactorily show that a defect exists.

Mitutoyo does not accept liability or responsibility for repairs, additions, or modifications made to the product, including those made by others, without Mitutoyo’s written consent.

The warranties Mitutoyo provides do not adversely affect Mitutoyo’s right to modify or change the design of products, without notice, including any of its specifications or materials.

MRM Manufacturing Warranty

For this device we give a warranty in accordance with the following conditions:

1. We will repair free of charge and damage or defects which are demonstrably based on a manufacturing error, if they are reported to us immediately when they are terminated and within 24 months of the date of purchase, in accordance with the normal conditions below (Nos.2-5). The warranty does not cover minor deviations from the normal condition which are irrelevant to the value and performance of the device.

2. The warranty is undertaken in such a way that the defective parts will be repaired or replaced with faultless parts free of charge. The unsatisfactory device should be returned to us, together with the invoice including the date of purchase or delivery. We will assume possession of the replaced parts.

3. The right to claim under guarantee is void if repairs or operations are carried out by persons not authorized by ourselves or if our device is fitted with additional parts or accessories that are non-standard for our device.

4. The manufacture will honor the warranty.

5. A performance under the warranty does not affect an extension of the warranty period or initiate the commencement of another warranty period. The warranty period for any replacement parts installed ends at the same time as the warranty period for the whole device.

6. More extensive or further claims, in particular for the replacement of damaged resulting outside of the device, are excluded – as long as liability is not legally required.

7. Subject to technical alterations.

Ohaus Warranty

OHAUS products are warranted against defects in materials and workmanship from the date of delivery through the duration of the warranty period. During the warranty period OHAUS will repair, or, at its option, replace any component(s) that proves to be defective at no charge, provided that the product is returned, freight prepaid, to OHAUS. This warranty does not apply if the product has been damaged by accident or misuse, exposed to radioactive or corrosive materials, has foreign material penetrating to the inside of the product, or as a result of service or modification by other than OHAUS. In lieu of a properly returned warranty registration card, the warranty period shall begin on the date of shipment to the authorized dealer. No other express or implied warranty is given by OHAUS Corporation. OHAUS Corporation shall not be liable for any consequential damages. Winters Warranty

A 5-year warranty applies to all instrumentation and instrumentation accessories.

Winters Instruments’ products are warranted for a stated period of time (see above) after date of purchase against manufacturing and materials defects. Any product which is found by Winters to be defective will be replaced at Winters’ discretion. Winters’ product warranty does not cover product defects resulting from improper product selection, misuse, or misapplication EXCEPT AS SPECIFICALLY SET FORTH IN THIS WARRANTY.

WINTERS INSTRUMENTS MAKES NO REPRESENTATION OR WARRANTY OF ANY KIND, WHETHER EXPRESSED OR IMPLIED, TO PURCHASER OR ANY OTHER PERSON WITH RESPECT TO ANY OF THE PRODUCTS. WITHOUT LIMITING THE GENERALITY OF THE PRECEDING SENTENCE, WINTERS INSTRUMENTS DISCLAIMS THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Any liability from Winters to Purchaser or any other person or entity pursuant to this Warranty, whether for a claim in tort, for breach of contract or otherwise, shall not exceed the purchase price of the Product giving rise to such liability.

Winters shall in no event have any liability to Purchaser or any other person or entity for any consequential, indirect, punitive or special damages (including, without limitation, lost profits) pursuant to this Warranty or pursuant to its sale of the Products, even if the possibility of such damages could have been foreseen by Winters Instruments.
